Omaha Man Convicted Of Killing Man During Robbery



A Douglas County jury has convicted another defendant of killing an Omaha man during a botched robbery. Tuesday the jury found 22-year-old Marqus Patton guilty of first-degree murder and use of a weapon to commit a felony. He was charged in the shooting death of 25-year-old Kristopher Winters in July 2011. Patton's first trial ended in a hung jury in July. He is scheduled to be sentenced in January. An accomplice, Ryan Elseman, was convicted of the same charges in September and will be sentenced on Friday. Prosecutors have said Patton, Elseman and three others planned to steal Winters' marijuana. Investigators have said Patton and Elseman pistol-whipped Winters and that Elseman shot Winters when he tried to fight back.
